Terms & Conditions

1 - Consumer Contracts Regulations for Distance Selling

At Modern Warrior Ltd we adhere to the Customer Contracts Regulations for distance selling, which came in to force 13 June 2014, and implement the Consumer Rights Directive into UK law.

This set of regulations is designed to give you rights when shopping online, so you're covered if things go wrong.

These rights apply to orders which have been made Online, over the Phone, or otherwise off-premises from one of our Retail Stores.

1.1 - Information you should expect from us

Before placing an order online we will supply the following:

  • Information about ourselves, including our address and contact details
  • A description of the goods, or service.
  • The total price of the goods including relevant taxes
  • Payment options
  • Details of your right to cancel and when this doesn’t apply
  • Details of who pays for the cost of returning items
  • Delivery information including costs and estimated delivery times

At Modern Warrior we try to make this information as clear as possible, with all product details being as up to date as possible on our website, and with the ability to calculate delivery times in the basket. Additional information you may require will be displayed during the checkout process.

1.2 - Right to cancel

When purchasing items online or by phone you have the right to cancel an order up to 14 days after the order is delivered.

This 14 day period is the time you have to decide and notify us of your wish to cancel, once you have notified us you then have a further 14 days to actually send the goods back.

You do not need to provide a reason for cancelling within this period.

When cancelling an order in this manner a refund will be issued once the unwanted items have been returned and inspected.

If you do wish to cancel an order please simply call us on 01622 370628 where one of our friendly customer care team will be able to assist you.

1.3 - When there is no right to cancel

There are some circumstances where the Consumer Contracts Regulations don't give you a right to cancel an order.

Examples of this are:

  • Items which have been tailor made or customised, such as a two toned or modified workshop items [i.e. altered from their original state at your request].
  • Goods that have been mixed inseparably with other items after delivery
  • Goods that have been altered after receipt, either by you or a 3rd party
  • Where items have been used more than would be needed to inspect the items as you would reasonably do in a shop prior to purchase [a reduced refund may still be available, please contact us to discuss this].
  • Services that have been completed in full prior to the return [such as workshop modifications and custom paint services etc]

1.4 - Cost of returning items and refunds

Unless an item is faulty on receipt or not as described the postage cost of returning any unwanted items would be the responsibility of the customer. If you have received an item that is faulty or where an incorrect item has been sent in error we will be happy to arrange for a free of charge return [see our returns section for more details].

1.6 - Delivery Arrangements

The delivery cost and an approximate delivery time will be shown at the basket stage, prior to completing the order, we offer different delivery options depending on your delivery location and where possible provide the choice of a next working day service, please note that with any other delivery option we can only provide an approximate delivery date and no guarantee is provided of the specific date the delivery will be made.

As the delivery is provided via a courier service it is important that you ensure there will be someone available at the delivery location to sign for the parcel. No refund of the delivery cost will be made for failed deliveries where there has been no-one available to accept the parcel.

Although every effort will be made to ensure that all orders are delivered in a timely manner there can be events outside our control that may cause a delay in delivery.

This can include events such as vehicle breakdown, accidents and stock issues [such as missing items due to damage or store theft etc]. On these occasions we will do our best to minimise any inconvenience to you and will look to keep you informed, however we will not cover any consequential costs incurred [such as time off work, missed game days etc].

All our deliveries are made via a courier service and We reserve the right to use the courier of our choice for each delivery.

We also offer a "Click & Collect" service at our shop during opening times or at Apocalypse Airsoft on game days.

3 - Weapon Specific Terms

3.1 - FPS [feet per second]

The stated feet per second (FPS) listed on our website is based on the results achieved on the first unit taken into stock from our suppliers. Subsequent units on newer deliveries or new production runs may deviate from this figure substantially.

Before dispatch we check weapon power [FPS Levels] ourselves in store using Chronometers to ensure compliance in accordance with UK Laws. This check is done solely for this purpose and is not done in relation to checking the performance, range or accuracy of the item.

If the power level [FPS] of the unit is of particular importance to you, the end user, please Contact Us prior to your purchase and we will try our best to cater to your needs.

3.2 - 11.1V LiPo

11.1V LiPo batteries are for use in highly tuned and modified AEGs ONLY. The use of an 11.1V LiPo, 10.8V NiMh/NiCd or higher voltages would be classed as miss-use and voids all warranty on all AEGs supplied by us, Modern Warrior Ltd, unless specified by ourselves on the product page on our website. This includes units where manufacturers, suppliers, other retailers or the Airsoft media state that a unit is 11.1V LiPo ready.

11.1v LiPo batteries should only be used in guns where we have specifically stated that the item is suitable for 11.1v LiPo in the product specification or description of the product.

11.1v Batteries can cause catastrophic gearbox damage to any AEG which is not purposely built or subsequently modified to run higher voltage batteries.

Many AEGs can run 11.1 batteries when set up at higher energy (High FPS) levels such as those not allowed by UK law.

AEG motor speed will be increased using higher voltage batteries. The increase in speed can be such that the cycle speed of the gearbox in particular the sector gear (the gear which pulls back the piston) can cycle a full revolution before the piston comes to rest. The sector gear will then collide with the piston rack as it travels in the opposite direction on the firing stroke.

The energy of the impact is far greater than that encountered by the pick-up tooth on the piston in normal use and as such can cause damage to one or more components.

Teeth can be broken from the piston rack and any of the gears. Gear shafts particularly spur gear shafts can snap and bearings can be damaged.

If in doubt consult a reputable Airsoft technician. Do not fire even one shot with an 11.1 battery connected if there is any doubt your AEG is not set up to handle the extra cycle speed.

When purchasing a 11.1v LiPo battery you will be warned at the checkout and have to state that you accept this warning.

3.3 - User Error

If any problems are deemed to have arisen from user error we cannot accept a return or issue a refund, we may still be able to help you in repairing the problem however this may be a chargeable service.

Examples of user error are, and not limited to:

3.3.1 - Weapon Modification

We do understand that users like to modify their weapons, however we may not be able to cover a repair once a permanent alteration or modification has been made, or if the weapon has been taken apart outside of expected maintenance (such as for normal cleaning and lubrication).

3.3.2 - Stripping a Weapon Completely during Cleaning

Although regular maintenance is essential and failure to perform this can lead to premature wear or damage, incorrectly maintaining or excessive dismantling can also cause issues.

Stripping and cleaning a gas powered weapon only entails splitting the slide and frame [or receiver on a rifle], checking seals, wiping dirt from moving parts and applying fresh lubricant. Removing parts, such as the trigger mechanism, can cause damage and is considered user error.

Maintaining an electric powered weapon only typically entails basic cleaning to ensure the item is free from dirt and debris. Any further work, such as gearbox maintenance, should be carried out by our Shop Technicians.

3.3.3 - Use of Poor Quality BBs

There are many different brands and types of BBs available and you do not have to purchase them from ourselves, however we do ask that you ensure that the ones you do use are of good quality.

Please don't use cheap / low quality BBs in airsoft replicas supplied by us, if we find evidence that low quality BB have been used we may not be able to accept a return or offer a refund.

Unfortunately, more and more RIFs booked in to our workshop with damage caused by a poor choice of BB. Poor quality BB’s are BB’s which have been manufactured in a location with poor quality control, resulting in ammo which breaks easily, has mold lines, injection marks or poor weighting ratio.

We recommend any of the brands that you will see available on our website, if we feature the BBs on our website we have typically tested them thoroughly and can confirm they are safe to use with your Airsoft Weapons.

3.3.4 - Accidental Damage by Dropping, Miss-use and Debris etc

Although airsoft guns are typically built and designed to last they are at the end of the day still toys, and as such are not manufactured to the same build quality as real firearms. Dropping, hitting, throwing, and dipping in mud etc can cause permanent damage to airsoft replicas. We cannot accept returns of weapons that have been mistreated, abused or with parts missing and broken etc.

3.3.5 - Use of the incorrect Charging unit

Please ensure that when charging batteries the correct type of charger is used. For example, do not use a Li-Po charger to charge a Ni-Mh battery, or a Ni-Mh charger to charge a Li-Po battery. Please read all supplied instructional material, as we cannot accept the return of items damaged in this way.

3.4 - Included Free Chargers / Batteries

A number of manufacturers include a free battery and charger in the box, although this can be quite handy when just starting out, we would always highly recommend purchasing a separate battery and charger.

The reason for this is it is typical for these items to be a very cheap / low quality product that will not allow you to get the best out of your new gun. The charger is usually of an EU style 2-pin plug [which can be used in a normal UK shaver socket] and does not offer safety features, included on aftermarket options, like an auto-shut off feature when the battery is fully charged, the battery is also usually of a lower capacity than aftermarket ones and will need recharging far more often.

Due to the nature of these items, and the fact that we do not stock them separately, unfortunately we cannot accept returns of these batteries and chargers if they come supplied with a weapon as a ‘free gift’ from the manufacturer.

3.5 - Removing Screws, Nuts and other Parts using the Improper Tools

We cannot accept the return of items which have been taken apart using the wrong tools, or have had screws, nuts or bolts damaged due to mistreatment. Please ensure that you do not use ball headed Allen keys on any airsoft equipment, as this can lead to threading and serious damage.

Please note, this includes all screws and nuts, including the quick change spring release nut at the back of some receivers.

3.6 - Use of Incorrect Lubrication

Do not use lubrication which is not designed for use with airsoft products. We cannot accept returns, or cover the cost of repairs for weapons which have been damaged through the use of inappropriate lubricants.

Examples of an appropriate range of lubricants are the Abbey range of lubricants found on our website.

Examples of inappropriate lubricants are: WD40, abrasive lubricants, and mineral oil based lubricants.

We recommend that you only use the type of lubricants available through our website, if you are unsure of what to use please get in touch with us via our Contact Us page.

4 - Pricing

We try to make sure that our pricing is as accurate and as fair as possible. The correct price for any product is that displayed on the website at the time we receive your order. If we make a mistake on price and it is higher than it should be then we will refund the difference.

We will always try to give you the best possible deals and to be as fair as possible on price.

If an item is on sale, it might have been sold in our retail store. If so, the 'was' price will always be the highest price in the last 12 months via any of our companies, websites or retail stores, and it will have been at that price for at least 28 consecutive days. The 'now' price will always be the current lowest price.

5 - Stock Availability

We always try to make sure that stock levels are as accurate as possible, and we always try to keep items in stock ready to be sent to you as soon as you want them. Items on sale might run out at any time. Once we have run out of stock we will not be able to accept any orders for the item.

Despite our best efforts to maintain good availability of all items, it is unfortunately the nature of the airsoft industry that many manufacturers only offer limited availability of some items and also can sometimes cease production of some items during certain times of the year, this can lead to products being unavailable for for extended periods. We will always look to offer alternative items wherever possible but cannot guarantee availability of all items at all times.

6 - Ordering & Payment

We accept credit card and debit card payments via our secure website, or over the phone and in addition PayPal payments via the website [excluding via PayPal Cheque].

We might not be able to accept your order if:

  • Your funds don't clear, whether you are paying by credit/debit card or PayPal
  • We have made a pricing or product description error
  • A product is out of stock, is not available, or was a sale item and all stock has cleared
  • We believe you are not using our website responsibly
  • You attempt to pay by PayPal Cheque

We care a lot about protecting you from fraud. If we suspect that your card has been stolen and someone else is using it then we will not sell the goods to them. For this reason, we reserve the right to refuse any order.

7 - Age Restriction

In order to purchase an Airsoft Weapon, also known as a Replica Imitation Firearm, you must be over 18.

When ordering you will be asked to confirm your Age which will be stored against the order as proof, and if required we reserve the right to put your order on hold until we have received proof that you are over 18.

8 - Preview Images

The images of the Airsoft Weapons on our website are preview images, meaning that the product may appear different to the image online.

9 - Order Holding

We reserve the right to hold your order should we be required to stop your parcel for legal reasons. If we hold your parcel we will attempt to contact you immediately, and attempt to re-contact you every few days.

Should we not be able to contact within an appropriate amount of time we will cancel your order, and refund you.

Below are some possible reasons for orders being held:

  • Your Defence is not Valid
  • The name on your Defence is different to the one provided with the Defence
  • Your Address does not match the Address on your Defence
  • Your address is incorrect
  • The incorrect postage option was selected
  • Item(s) on your order are no longer available
  • Item(s) on your order were found to be broken during Quality Control

Please be aware that we will not send out your order if your Defence is invalid, as it is required by law.

11 - Game Vouchers

Redemption

Modern Warrior game vouchers (Apocalypse Airsoft vouchers), will be automatically added to the total amount of purchased products per transaction [excluding postage] on modernwarrior.co.uk.

As from 01/01/2022 regards to the total amount purchases, every £150+ will give you one game voucher only.

Modern Warrior game vouchers can be used only at Apocalypse Airsoft, location and details will be available on the voucher.

Once used, game vouchers cannot be used again and again.

Limitations

Game vouchers expire at the end of that year.

Game voucher on returned items will result in a reasonable deduction of refund. Any concerns regarding the use of game vouchers, please contact us.

Risk of Loss

We are not responsible if any game vouchers are lost, stolen, destroyed or used without your permission. Please protect any game voucher and treat it as cash, as they cannot be replaced if lost, damaged or stolen.

Fraud

We will have the right to refuse customer entry if we believe game vouchers are fraud or tempered with.
